1. Acceptance of Terms
By accessing or using the OsonDauSon mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Definitions
- "Service" means the OsonDauSon mobile application and all associated features and services.
- "User" means any individual who accesses or uses the Service, including registered members and guests.
- "Member" means a User who has created an account through social login.
- "Caregiver" means a parent, grandparent, or other guardian registered as a caregiver for a child within the Service.
- "Content" means any text, images, comments, suggestions, and other materials posted by Users within the Service.
- "Suggestion" means any feature request, improvement idea, feedback, or other submission made through the "Build Together" feature.
- "DauSon" means the AI-powered parenting assistant (DauSon AI) provided within the Service.
- "Marketplace" means the platform feature for secondhand trading and group buying of parenting products.
- "Influence Score" means the composite score calculated to determine the priority of Suggestions.
3. Account Registration
- You may create an account through supported social login providers (Google, Apple, Kakao, Naver).
- You must provide accurate information and keep your account secure.
- You may not create accounts for fraudulent purposes, impersonate others, or create multiple accounts to manipulate Service features.
- You must be at least 14 years of age to create an account.
4. Service Description
The Service provides:
- Parenting Records: Sleep, feeding, diaper, bath, and vaccination tracking
- AI Analysis: Pattern analysis, personalized insights, AI memory system
- Hospital Finder: Location-based pediatric hospital search
- AI Stories: Photo-based personalized story generation
- Emergency Detection: AI-based audio analysis for emergency situations
- Caregiver Sharing: QR code-based caregiver invitation and record sharing
- Community: Posts, comments, likes
- Marketplace: Secondhand parenting product trading
- Group Buying: Collective purchasing through verified organizers
- Build Together: Feature suggestions, voting, and feedback
5. Free Service Policy
- Core features (parenting records, AI analysis, hospital finder, caregiver sharing, community, Build Together) are provided free of charge.
- We may generate revenue through: in-app advertising, sponsorships, partnership marketing, group buying commissions, and premium features (with advance notice).
- Existing free core features will not be converted to paid features.
6. User Obligations
You agree not to:
- Collect, store, or disclose other Users' personal information
- Impersonate others or register false information
- Use information obtained through the Service for unauthorized commercial purposes
- Harass, defame, insult, or threaten other Users
- Post illegal, harmful, obscene, or violent content
- Interfere with the normal operation of the Service (hacking, DoS attacks, bot abuse, etc.)
- Post commercial advertisements or spam without prior approval
- Manipulate Build Together votes through fake accounts or organized voting campaigns
- Violate any applicable law or these Terms
7. User Content
- You retain ownership of Content you post (community posts, comments, photos, etc.).
- By posting Content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display, distribute, and create derivative works of such Content for the purpose of operating, improving, and promoting the Service.
- We may remove Content that violates applicable law, infringes third-party rights, contains obscene or violent material, constitutes spam, or violates our policies.
8. Build Together — Suggestions and Feedback
8.1 Submission of Suggestions
You may submit feature requests, improvement ideas, bug reports, and praise through the "Build Together" feature. Submissions are categorized as:
- Feature Request ("I'd love this feature")
- Reduction Request ("I'd like less of this")
- Bug Report ("This was inconvenient")
- Praise ("Great job on this")
8.2 Influence Score
We calculate an "Influence Score" to help prioritize Suggestions based on:
- Total votes received
- Votes from active Users (who used the Service within the last 7 days)
- Number of active Caregivers invited by the Suggester
The Influence Score serves as a reference factor only. We make final decisions on development priorities based on technical feasibility, service direction, and available resources.
We reserve the right to reset votes, remove Suggestions, or restrict access for Users who manipulate voting through fake accounts, bots, or organized campaigns.
8.3 Intellectual Property Rights for Suggestions — IMPORTANT
PLEASE READ THIS SECTION CAREFULLY. BY SUBMITTING ANY SUGGESTION THROUGH THE BUILD TOGETHER FEATURE, YOU AGREE TO THE FOLLOWING TERMS:
Complete Assignment of Rights. All intellectual property rights (including but not limited to copyrights, patent rights, trademark rights, trade secrets, and any other rights) in any Suggestion, feature request, idea, proposal, feedback, or improvement opinion (collectively, "Submissions") that you submit through the Build Together feature are, upon submission, irrevocably, perpetually, worldwide, and royalty-free assigned to the Company without any separate compensation.
No Compensation. You shall not be entitled to any monetary compensation, revenue sharing, royalties, equity, or any other form of consideration for your Submissions. This applies regardless of whether the Submission is implemented in the Service, whether the Service generates revenue, and regardless of the amount of any such revenue.
No Revenue Sharing Claims. If your Submission is implemented as a feature of the Service and the Service generates revenue (including but not limited to advertising revenue, subscription fees, commissions, partnership income, investment proceeds, or any other economic benefit, whether direct or indirect), you may not claim any share, distribution, portion, or other economic interest in such revenue.
No Co-Creator Status. Submitting a Suggestion does not grant you the status of co-developer, co-creator, co-author, co-inventor, contributor, partner, or any similar designation with respect to the Service. No employment, contractor, joint venture, partnership, or other legal relationship is created between you and the Company by virtue of your Submission.
Free Use. We may freely use, modify, transform, redesign, combine, distribute, and commercially exploit your Submissions without any obligation to notify you, obtain your approval, or provide compensation. We are not obligated to implement any Submission as submitted, and may independently redesign or reinterpret Submissions before incorporating them into the Service.
Attribution. We may display messages such as "Improved based on user feedback" or similar phrases when implementing features inspired by user Suggestions. Such attribution is purely an expression of gratitude and does not confer any rights, claims, or legal status upon you.
Pre-Existing Rights. If your Submission contains intellectual property that you owned prior to submission, you grant us a non-exclusive, perpetual, worldwide, royalty-free license to use such intellectual property to the extent necessary for operating and improving the Service.
Third-Party Rights Warranty. You represent and warrant that your Submissions do not infringe any third party's intellectual property rights, trade secrets, or other rights. If a dispute arises with a third party due to your Submission, you shall resolve it at your own expense and indemnify the Company for any resulting damages.
Voluntary Submission. All Submissions are made voluntarily at your own initiative. The Company does not require, solicit, or compel Submissions.
8.4 Suggestion Processing
We provide status updates on Suggestions:
- Received: Your Suggestion has been received.
- Under Review: We are reviewing your Suggestion.
- Implemented: Your Suggestion has been reflected in the Service.
- On Hold: Implementation is currently not feasible.
We make no guarantees or commitments regarding whether or when any Suggestion will be implemented.
Implemented features may differ from the original Suggestion, as we independently redesign and reinterpret Submissions.
9. Marketplace and Group Buying
9.1 Marketplace
- The Marketplace is a platform service that facilitates transactions between Users. We are not a party to any transaction.
- Transaction disputes (product defects, non-delivery, fraud, etc.) must be resolved between the parties involved. We are not liable for such disputes but may assist in resolution upon request.
- You may not list prohibited items (pharmaceuticals, hazardous materials, counterfeit goods, stolen property, etc.).
9.2 Group Buying
- Only Users who have completed our verification process may create Group Buy listings.
- Payments are processed through our payment processor (PortOne). We do not store payment card information.
- If a Group Buy does not reach minimum participation, all payments will be fully refunded.
10. AI Services
- All information and advice provided by DauSon AI is AI-generated and does not replace professional medical, legal, or financial advice.
- You must use DauSon's responses as reference material only. For important health and safety decisions, always consult qualified professionals (doctors, pharmacists, etc.).
- We do not guarantee the accuracy, completeness, or timeliness of AI responses. We are not liable for decisions or actions you take based on AI responses.
- The emergency detection feature provides AI-assisted preliminary assessment only, not medical diagnosis. In actual emergencies, always call emergency services (119 in Korea, 911 in the US, or your local emergency number).
11. Limitation of Liability
- We are not liable for service interruptions caused by force majeure events (natural disasters, war, telecommunications provider outages, etc.).
- We are not liable for service disruptions caused by your own actions.
- We are not liable for disputes between Users or between Users and third parties arising through the Service.
- For free services, we shall not be liable for damages except in cases of willful misconduct or gross negligence.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or your use of the Service.
13. Account Deletion
- You may delete your account at any time through Settings > Delete Account.
- Upon deletion, your personal data and records will be permanently deleted in accordance with our Privacy Policy.
- Data required to be retained by law will be stored separately for the legally mandated period and then deleted.
14. Governing Law and Jurisdiction
- These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
- Any disputes arising from the Service shall be submitted to the competent court as determined by the Civil Procedure Act of Korea.
- For Users outside Korea: any disputes shall be resolved under the laws of the Republic of Korea, and you consent to the exclusive jurisdiction of the courts of Seoul, Republic of Korea.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, representations, and understandings.
17. Changes to Terms
We may modify these Terms from time to time. We will provide at least 7 days' notice (30 days for changes adverse to Users) through in-app notifications. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
